DAY 25: Erie Doctrine: Basic Erie

On Tuesday, October 21, the class began its discussion of the Erie doctrine with an overview of when the doctrine applies, the source of the doctrine in the Rules of Decision Act, and Professor Craig's review of the Supreme Court's decision in Swift v. Tyson, which Erie overruled. We then discussed the Erie case itself and the issues that follow from Erie -- the choice-of-law rules about WHICH state's law to apply and the process of figuring out what the state's law is.
